Right-of-Way Dedication

Land a developer is required to convey for future roadway at the time of platting.

When a jurisdiction's master thoroughfare plan shows a planned or widened roadway across a property's frontage, the subdivision ordinance typically requires the owner to dedicate the necessary right-of-way at platting. The effect is that acreage you paid for becomes public roadway, and the building envelope shifts back accordingly. Because the requirement appears at plat — well after the land is under contract — planned corridors should be checked against the regional and local thoroughfare plans during early diligence, not later.
